Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Platfio Pty Ltd ("Platfio", "we", "us", or "our") governing your access to and use of the Platfio platform, including platfio.com, content.platfio.com, any associated applications, and all related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not access or use the Service.

2. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

3. Account Registration

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@platfio.com if you suspect any unauthorised use of your account.

4. Use of the Service

4.1 Permitted Use

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service in accordance with these Terms and your applicable subscription plan.

4.2 Prohibited Conduct

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
  • Attempt to gain unauthorised access to any part of the Service, other accounts, or related systems.
  • Interfere with or disrupt the Service, servers, or networks connected to the Service.
  • Reverse engineer, decompile, or disassemble any aspect of the Service.
  • Use the Service to transmit malware, spam, or other harmful content.
  • Scrape, crawl, or use automated means to access the Service without our prior written consent.
  • Resell, sublicence, or redistribute the Service or any part thereof except as expressly permitted under your subscription plan.

5. Your Content

"Your Content" means any data, files, text, images, or other materials you upload, create, or transmit through the Service.

  • Ownership — you retain all rights in Your Content. Platfio does not claim ownership of Your Content.
  • Licence — by submitting Your Content, you grant Platfio a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you.
  • Responsibility — you are solely responsible for Your Content and represent that you have all necessary rights to submit it.

6. White-Label Applications

If you use Platfio to build and deploy white-label applications for your clients, you are responsible for ensuring that those applications comply with all applicable laws and that you have obtained the necessary rights and consents from your clients. Platfio provides the tools and infrastructure; the relationship between you and your end users is yours to manage.

7. Fees and Payment

Access to certain features of the Service requires a paid subscription. By selecting a paid plan, you agree to pay all applicable fees as described on our pricing page or in your subscription agreement.

  • Fees are billed in advance on a recurring basis (monthly or annually) via our payment provider, Stripe.
  • All fees are non-refundable except as expressly stated in these Terms or required by applicable law.
  • We may change our pricing with at least 30 days' notice before the change takes effect on your next billing cycle.

8. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period — you will retain access to paid features until then.

We may suspend or terminate your access to the Service at any time if you breach these Terms, if required by law, or if we discontinue the Service. We will provide reasonable notice where practicable.

Upon termination, your right to use the Service ceases immediately. We will make your data available for export for a reasonable period after termination.

9. Intellectual Property

The Service, including its design, features, code, documentation, logos, and trademarks, is owned by Platfio and protected by intellectual property laws. Nothing in these Terms grants you any right to use Platfio's trademarks, branding, or other proprietary assets without our prior written consent.

10. Third-Party Services

The Service may integrate with or link to third-party services (e.g., Google Cloud Platform, Firebase, Stripe, Apple Developer, Google Play). Your use of such third-party services is governed by their respective terms and policies. Platfio is not responsible for third-party services.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components, or that any defects will be corrected.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Platfio shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising out of or relating to your use of, or inability to use, the Service.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Platfio in the twelve (12) months preceding the event giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Platfio, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
